PRIOR TO A LOSS, BE SURE THAT EACH VEHICLE HAS A DRIVER PACKET CONTAINING AN ACCIDENT REPORT AND AN INSURANCE IDENTIFICATION CARD.
WHAT TO DO IN CASE OF AN ACCIDENT
- Immediately take whatever safety steps are necessary and prudent to insure that any injured individual receives proper medical attention.
- Obtain names, addresses and telephone numbers of all witnesses. This may be done by having them complete the witness card enclosed in the driver packet.
- Use the accident report form enclosed in the driver packet to obtain necessary information. (see forms for sample)
- If the police were present, obtain the investigating officer's name and badge number and which police department he/she is employed by (Houston, State of Texas, etc.). This will assist in obtaining a copy of the police report. Determine if any tickets were issued, to whom and for what.
- Find out where the vehicles were taken. Do not authorize anyone to make repairs until you are told by The GEM Agencies or an insurance company representative that it is all right to do so.
- Brief all employees to discuss the accident only with you, your representative and/or the police. They should not admit liability, rather just provide the facts.
- If an employee is injured, see the workers' compensation section.
- Report all information as soon as possible to The GEM Agencies: 713-622-2330.
THE POLICY STATES YOU MUST:
- Assume no obligation, make no payment or incur any expense without the carrier's consent.
- Immediately send copies to the carrier of any demand, notice, summons, or legal paper received concerning the claim or suit.
- Cooperate with the carrier in the investigation, settlement or defense of the claim or suit.
- Authorize the carrier to obtain medical records or other pertinent information.
- The driver must submit to examination, at the carrier's expense, by physicians of their choice, as often as they reasonably require.
IF THERE IS A LOSS TO A COVERED AUTO OR ITS EQUIPMENT, YOU MUST:
- Promptly notify the agency or company if the covered auto or any of its equipment is stolen.
- Take all reasonable steps to protect the covered auto from further damage. Also keep a record of your expenses for consideration in the settlement of the claim.
- Permit the carrier to inspect the covered auto and pertinent records before repair or disposal.
- Agree to examination under oath at the carrier's request and give a signed statement to your answers.
